This Privacy Policy (the "Policy") explains how we collect, use, disclose, retain, and protect your personal information when you use our website https://phonio.ca (the "Site") and our services (online purchase, delivery, returns, warranty, and support).

By using the Site or our services, you acknowledge that you have read this Policy.

Note: Your use of the Site and our services may also be governed by our Terms of Service and/or Conditions of Sale (if published). In the event of any inconsistency, this Policy applies to privacy matters.

1) What this Policy Covers

This Policy applies when you:

  • create a customer account (if the feature is enabled);

  • request a return, exchange, or warranty service;

4) Personal Information: What We Collect

Depending on your use, we may collect the following categories:

A) Profile and Contact Data

B) Order and Transaction Data
  • products/variants, quantities
  • price, taxes, discounts, amount paid

C) Payment (Processed by Providers)

Payments are processed by providers integrated into the platform (e.g., payment options available at the time of purchase). We generally do not store the full card number. We primarily receive confirmation information (status, transaction ID, method).

D) Customer Service, Returns, and Warranty

Certain information is necessary to provide the service (e.g., shipping address, contact). Without it, we cannot process an order or offer certain services.

  • enabled Shopify apps (reviews, marketing, shipping, support, etc.)

These third parties receive only the necessary information and must protect the data according to reasonable and/or contractual measures.

B) Communications Permitted or Required by Law

We may communicate information when required or permitted by law (e.g., requests from competent authorities) or to protect our rights (fraud, dispute).

C) Depersonalized / Aggregated Data

We may create aggregated, depersonalized, or anonymized data (no longer allowing your identification) and use it for legitimate business purposes (analysis, improvement, statistics).

10) Hosting and Transfers Outside Quebec / Outside Canada

We may entrust the processing of certain personal information to technological service providers. In this context, information may be processed or hosted outside of Quebec and/or Canada. Where required, we conduct a privacy impact assessment and implement appropriate protective measures, including written agreements with providers.

11) Security

We implement reasonable administrative, technical, and physical measures to protect your information (access controls, authentication, encryption/HTTPS, monitoring, access management, provider oversight).

No method of transmission or storage is completely foolproof, but we work to reduce risks in a reasonable manner.

Internal Access. Access to your personal information is limited to individuals who need it for their duties, specifically: customer service and support, preparation/shipping and logistics, billing/accounting, and management/administration. These individuals are bound by confidentiality, and access is granted according to the "need-to-know" principle.

12) Privacy Incidents

In the event of a privacy incident (unauthorized access, loss, disclosure, etc.), we take steps to limit risks, correct the situation, document the incident, and provide required notices where applicable.

We document incidents and maintain a register in accordance with applicable legal obligations.

13) Retention and Destruction

We retain your information as long as necessary for the described purposes and according to legal requirements.

As a guideline:

  • information related to orders and supporting documents: generally up to 6 years (tax and accounting obligations);
  • exchanges with customer service/warranty: for the duration necessary for processing, then for a reasonable period to manage follow-ups and applicable obligations.

Upon expiration, we securely destroy, anonymize, or archive the data, as appropriate.

14) Your Rights

Subject to applicable law, you may request:

  • withdrawal of consent (where applicable)
  • deletion/anonymization in certain cases (subject to legal obligations)
  • portability, where provided (subject to applicable conditions)

We may request proof of identity. We respond no later than 30 days after receiving a compliant request (a period that may be extended if permitted by law, with notice).

15) Automated Decisions (if applicable)

We do not make decisions that produce significant legal effects solely on the basis of automated processing.

We may, however, use automated tools to assist in fraud detection or security (e.g., risk signals). You can write to us to obtain information on the general operation of these tools, where applicable.

16) Minors

The Site is not intended for the voluntary collection of personal information from minors. If we were to collect personal information from a minor under the age of 14, consent must be given by the holder of parental authority or the guardian, except for exceptions provided by law.

The Site may contain links to third-party sites (carriers, social networks, etc.). We are not responsible for their practices. Please consult their policies.

19) Business Transactions

In the context of a business transaction (e.g., reorganization, merger, acquisition, financing, asset sale), information could be communicated to the involved parties only to the extent permitted by law and with appropriate protective measures. If the transaction concludes, the information could be transferred to the successor, subject to legal requirements.

20) Modifications

We may modify this Policy. The update date is shown at the top. If required, a notice will be published on the Site or communicated by any other appropriate means.
